Terms of service
Terms of Service
OVERVIEW
This website is operated by Herbis. Throughout the site, the terms "we", "us" and "our" refer to Herbis. We offer this website, including all information, tools and services available from it, to you, the user, conditioned upon your acceptance of the terms, conditions, policies and notices set out here.
By visiting our site or purchasing from us, you engage in our "Service" and agree to be bound by these Terms of Service, including the additional terms and policies referenced in them or available by hyperlink. These Terms apply to all users of the site, including browsers, customers and contributors of content.
SECTION 1 — ONLINE STORE TERMS
By agreeing to these Terms, you confirm that you are at least 18 years old. You may not use our products for any unlawful purpose, or use the Service in breach of any law that applies to you, including copyright law.
SECTION 2 — GENERAL CONDITIONS
We may refuse service to anyone where we have reasonable grounds to do so. You understand that your content, excluding payment card details, may be transferred unencrypted and may involve transmission across various networks and changes made to meet the technical requirements of connecting networks or devices. Payment card information is always encrypted in transit.
SECTION 3 — CHANGES TO THE SERVICE AND PRICES
Prices for our products may change. Any change takes effect from the time it is published and does not affect orders we have already accepted. We may modify or discontinue the Service, or any part of it, at any time. Where a change affects an order you have already placed, we will contact you before proceeding.
SECTION 4 — PRODUCTS
Some products are available exclusively online and may be limited in quantity. Returns and cancellations are handled under our Cancellation & Refund Policy, which sits alongside your statutory rights and does not replace them. We make every effort to display product colours and images accurately, but we cannot guarantee that your screen will reproduce colour exactly.
SECTION 5 — ORDERS, PRICING ERRORS AND ACCOUNT INFORMATION
Your order is an offer to buy. A contract is formed only when we send you a dispatch confirmation email. We may decline an order or limit quantities per person, household or order, and will tell you if we do. If a product is listed at an incorrect price due to an obvious error, we may cancel the order and refund you in full rather than supply at that price. You agree to provide accurate and complete purchase and account information.
SECTION 6 — PERSONAL INFORMATION
Your personal data is handled in accordance with our Privacy Policy and UK GDPR.
SECTION 7 — LIABILITY
We do not guarantee that your use of the Service will be uninterrupted, timely, secure or error-free.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be limited or excluded under English law. Your statutory rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 are unaffected by these Terms.
Subject to the above, we are not liable for losses that were not foreseeable at the time the contract was made, or for losses arising from your use of the site or products in a way we did not intend.
SECTION 8 — GOVERNING LAW AND JURISDICTION
These Terms and any separate agreements under which we provide Services are governed by the laws of England and Wales. If you live in Scotland or Northern Ireland, you may bring proceedings in your own courts; otherwise the courts of England and Wales have jurisdiction.
SECTION 9 — COMPLAINTS
If something goes wrong, email info@tryherbis.com and we will respond within 5 business days. If we cannot resolve it, you may be able to refer the matter to an alternative dispute resolution provider or contact Citizens Advice consumer service.
SECTION 10 — CHANGES TO THESE TERMS
The current version of these Terms is always available on this page. We may update or replace any part of them by posting changes to the website. The version in force at the time you place an order is the one that applies to that order.
